FMLA 'Final Rule' Now in Effect

Amendments benefit military families and flight crew employees

To celebrate the 20th anniversary of the Family and Medical Leave Act (FMLA), the Department of Labor amended the Act with expanded provisions for military families and flight crew employees.

Effective March 8, 2013, the 'Final Rule' offers three significant updates to FMLA:

  • Veteran coverage. Families of eligible veterans now have the same job-protected leave as families of active service members.
  • Military family activities. The list of activities related to the deployment of a service member have been expanded, allowing more military families to qualify for leave for events such as farewell and homecoming ceremonies.
  • Airline personnel eligibility. Eligibility criteria for flight crews have been adjusted so that more airline personnel can take advantage of qualified FMLA leave. Prior to the 'Final Rule,' many airline employees were considered ineligible for FMLA leave due to the way their hours were counted.

"Today's rules make clear this […] strong, ongoing commitment […] to the needs and sacrifices of our military families," said Acting Secretary of Labor Seth Harris. "The rule also helps ensure that pilots and flight crews will no longer need to choose between career and caring for a loved one."
